What is Probate?

Probate is the formal, court-supervised process of fulfilling the last will & testament of the deceased, resolving any outstanding debts or taxes owed, and distributing the remaining assets to the heirs and surviving family members. The process follows this general timeline:

  • 01 File a petition with the court
  • 02 Appoint a Personal Representative
  • 03 Submit a will if one exists
  • 04 Take inventory & submit valuations for all relevant assets
  • 05 Obtain court and beneficiary approval
  • 06 Distribute the assets to beneficiaries

What is the Role of a Personal Representative?

The executor or Personal Representative of an estate is responsible for:

  • Filing a petition for probate to the probate court in the county where the deceased lived
  • Deciding if there are any probate assets
  • Locating and appraising the assets
  • Receiving payments and paying taxes and debts on behalf of the estate
  • Setting up an estate checking account and EIN
  • Interpreting the will
  • Communicating and working with heirs/beneficiaries
  • If there is no will, then distributing assets according to local law
  • Officially notifying creditors
  • Following all legal deadlines
  • Paying funeral bills
  • Filing estate tax returns
  • Submitting death certificate
  • Submitting distribution receipts and officially closing the estate

Should I use a Probate Realtor®?

Selling a home of a decedent through Probate is different from selling your own home. Because of this, it is important to use a Realtor® who has Probate experience. A Probate Realtor® will work with your attorney and the court to ensure all real estate contracts are written up correctly and all extra documentation is submitted. They will have a thorough understanding of the process and help you avoid delays and pitfalls that could cause unnecessary stress. They will also have referrals to other resources and services that you will likely need along the way.
